California State Legislature Scorecard - 2013-4

 

(1) Industrial Hemp SB 566 (Sen. Mark Leno - SF). Bill to legalize cultivation of industrial hemp once federal law permits. Approved by Senate 39-0 and Assembly 70-5 and signed into law by Gov. Brown.

(2) Possession of Controlled Substances: SB 649 (Sen. Mark Leno -SF). Bill to downgrade simple possession of narcotics (opium, cocaine, peyote, etc.) from a mandatory felony to a wobbler (alternate misdemeanor or felony). Passed Senate 24-14, Assembly 41-31. Vetoed by Gov. Brown to public surprise and dismay despite the state's prison overcrowding crisis.

(3) Drug Transportation: AB721 (Assemblyman Steven Bradford - Gardena). Redefines "transportation" of drugs to mean "transportation for sale," thus eliminating felony penalties for marijuana transportation for personal use. Passed Assembly 44-33; Senate 24-15; signed by Gov. Brown.

(4) Medical Marijuana Regulation: SB439/AB473 (Steinberg / Ammiano). Medical marijuana proponents have been frustrated in their efforts to establish uniform, statewide, consumer-friendly regulations for the industry. Legislation is badly needed to clarify the state's notoriously vague laws regarding sales, production, and manufacture of marijuana, which have precipitated hundreds of lawsuits, and to satisfy the U.S. Department of Justice's demand for "strong and effective" state regulations as a condition for respecting state marijuana laws. In 2013, advocates supported a pair of complementary regulation bills: (1) SB 439 by Sen. Darrell Steinberg (D-Sacramento), which would have codified the legality of collectives operating under the California Attorney General's guidelines, and AB 473 by Assemblyman Tom Ammiano (D-SF), which would have established a comprehensive state regulation system under the Alcoholic Beverages Commission. SB 439 passed the Senate 22-12, but was held back from the Assembly after AB 473 unexpectedly failed 37-35, four votes short of passage, due to fierce opposition from law enforcement and the California League of Cities. In 2014, two more medical regulation bills failed in the legislature. Tom Ammiano's AB 1894, based on his proposal from last year, was again rejected 26-33 in the Assembly due to strong opposition from law enforcement. Meanwhile, an alternative bill by Sen. Lou Correa, SB 1262, co-sponsored by law enforcement and the California League of Cities, died in the Assembly Appropriations Committee amidst concerns about its viability and cost of enforcement.

(5) No Jail for Use of Controlled Substances: AB 2515 (Assemblyman Tim Donnelly - Twin Peaks). Bill to eliminate mandatory 90-day jail sentences for use of certain controlled substances (e.g. narcotics, but not marijuana). Failed Assembly seven votes short of passage 34-16 due to abstentions by many Republicans and moderate Democrats. No Senate vote.

(6) Fair Sentencing for Crack Cocaine SB 1010 (Sen. Holly Mitchell - Culver City) To reduce the sentences for sale or intent to sell crack to the same as cocaine base. Approved by Senate 21-12, Assembly 50-19.
